Agreement

These Terms & Conditions ("Terms") are an agreement between you and Hemi Enterprises ("we", "us") governing your use of The 19th Club mobile app and website (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.

Eligibility and your account

• You must be at least 18 years old to use the Service.
• You agree to provide accurate information and keep your account credentials confidential. You're responsible for activity that happens under your account.
• One account per person. Don't impersonate anyone or misrepresent your identity, handicap, or affiliation.

The service

The 19th Club helps golfers find people to play with: you can post tee times, browse other members, request to join rounds, chat, form groups, and track rounds and scores. We are a platform for connecting golfers — we do not operate golf courses, book tee times with courses, vet or background-check members, or supervise rounds.

Meeting other members in person

The Service is designed to lead to real-world meetups. You are solely responsible for your interactions with other members, on and off the course. We don't screen members, and we make no representations about anyone's identity, conduct, or ability. Use good judgment: meet in public places (golf courses generally are), tell someone where you're going, and report concerning behavior to us at the19thclubapp@gmail.com.

Games, scores, and stakes

The Scores feature lets you record rounds and common golf game formats, including games traditionally played with stakes (such as skins or Nassau). The Service only records scores and results. It does not calculate, hold, transfer, or settle money, and we are not a gambling service, bookmaker, or payment processor.

Any wager between you and other members is a private arrangement made entirely at your own risk. You are solely responsible for ensuring any such arrangement is lawful where you play. Don't use the Service to organize wagers where doing so is illegal.

Your content

You own the content you post — profiles, tee times, messages, and scores. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, store, and display that content as needed to operate the Service (for example, showing your tee time post to other members). This license ends when your content or account is deleted, except for content in routine backups or already shared with other members (such as messages you sent).

Acceptable use

You agree not to:

• Harass, threaten, or abuse other members, or post content that is hateful, obscene, or unlawful.
• Spam, advertise, or solicit members for unrelated commercial purposes.
• Scrape, copy, or harvest data from the Service, or access it by automated means.
• Attempt to probe, disrupt, or gain unauthorized access to the Service or other members' accounts.
• Use the Service for any unlawful purpose, including unlawful gambling.

Termination

You can stop using the Service or request account deletion at any time by emailing the19thclubapp@gmail.com. We may suspend or terminate your account if you violate these Terms, create risk for other members, or if we discontinue the Service. Sections of these Terms that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Golf involves inherent risks; you participate in rounds arranged through the Service at your own risk.

Limitation of liability

To the maximum extent permitted by law, Hemi Enterprises will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the Service — including disputes, wagers, injuries, or interactions between members. To the extent any liability is not excludable, our total liability for all claims relating to the Service is limited to the greater of $50 or the amount you paid us in the past twelve months (currently $0).

Indemnification

You agree to indemnify and hold harmless Hemi Enterprises from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, your interactions or arrangements with other members, or your violation of these Terms or applicable law.

Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Virginia, and you consent to their jurisdiction.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the date at the top and, where appropriate, notify you in the app or by email. Continued use of the Service after changes take effect means you accept the updated Terms.
